AHLG Obtains Full Acquittal in General Order Violation Case 01-18-2011

Fort Riley, Kansas.

A staff sergeant stationed at Balad, Iraq, was accused of various General Order Number One violations for Consuming, Possessing, Transferring, Introducing and Purchasing Alcohol. The staff sergeant was also charged with Conspiracy, Dereliction of Duty for Losing Consciousness During Various Combat Missions and Fraternization.

Partner Duane Kees began his representation by filing several suppression and discovery motions. Because of the pretrial efforts of Duane, the Fraternization and Dereliction charges were dismissed twenty hours prior to trial. Of the remaining three charges, Duane was able to have two dismissed during trial by the military judge due to the government’s failure to prove its case. The dismissal of the charges was in large part based upon testimony during Duane’s cross examination of the government’s expert witness. Of the remaining charge, the military panel (jury) took just three minutes to return a verdict of not guilty.
