AHLG Prevents Charges from Being Filed and Secures Retirement for Army Sergeant Major 01-07-2011

Fort Lewis, Washington.

An Army sergeant major with over 22 years of service was being investigated for various allegations surrounding an altercation. The allegations ranged from Assault, Disrespect and Disorderly Conduct to Public Intoxication. The sergeant major was placed in pretrial confinement.

Duane Kees was retained within days of the incident, and the sergeant major was subsequently released from pretrial confinement and placed on restriction to the Post. Duane became fully involved in the case, and with the help of both experts and eyewitness accounts, was able to present an effective offer to the government. After five long, arduous months of negotiations with the command and the prosecutors, Duane was able to work out an arrangement whereby the sergeant major was permitted to acquire a waiver from the Department of Army and retire honorably at the rank of sergeant major.
