A Sergeant stationed at Fort Bliss, Texas was charged with several violations of the UCMJ, including assault, sexual assault, sexual harassment, communicating a threat and various other violations. The alleged victims ranged from subordinates to commissioned officers. The government was preparing for a general court martial when Duane Kees was retained to represent the NCO.
Once retained, Duane began his investigation by interviewing witnesses and collecting information that he disclosed to the prosecution. After lengthy negotiations, the prosecution and the command decided to accept an administrative discharge in lieu of court martial, allowing the NCO to be discharged without a court martial and without the threat of conviction and sex offender registration.
