A Commissioned Officer stationed at Ramstein Air Force Base in Germany was being investigated by the Air Force's Office of Special Investigations (OSI) for sexual assault, assault with a deadly weapon, fraternization and simple assault. If charged and convicted, the officer would face the possibility of a dismissal and confinement in excess of forty years.
Both OSI and the command were so certain that a court martial was inevitable that the officer's orders to his new duty station were suspended pending the investigation and possible court martial. During the investigation process, Duane Kees was retained to begin his own investigation and prepare for the possibility of a court martial. Duane flew to Germany to conduct his investigation in person and immediately found eyewitnesses supporting the officer's innocence.
After negotiations with the prosecution and the command, charges were never filed against the officer, and he was given only a letter of reprimand. The officer is still on active duty and serving proudly.
